Terms and Conditions

Welcome to bAIome Compute Infrastructure for research and education, provided by the bAIome Center for Biomedical AI at University Medical Center Hamburg-Eppendorf.

These Terms and Conditions govern access to and use of three distinct infrastructure environments:

• Teaching
• Research
• High-Security Research (KIS1 Abt)

This includes all associated services, content, tools, features, and functionality provided as part of these services.

Access to the Services is restricted to:

Access may be revoked or denied if eligibility requirements are not met.

To use the Services, users are required to authenticate their identity using credentials provided by bAIome.

• Users are responsible for maintaining the confidentiality and security of their credentials.
• Users agree to promptly notify the Service administrator of any unauthorized access or security breaches.

The Services are intended for academic, research, and educational purposes only. The following activities are permitted:

• Running simulations, analyses, or other computational tasks for research projects.
• Storing and processing academic data.
• Using software or tools for educational purposes in courses and virtual labs.

Prohibited uses include, but are not limited to:

The Services may impose limits on the usage of computational resources to ensure fair access. Users must specify desired values for GPU, CPU, RAM, and disk space resources. Actual resource allocation may vary from requested values.

Users will be notified if they exceed their allocated resources or if resource usage needs to be adjusted for operational reasons.

• Users must ensure compliance with all applicable data protection regulations when handling personal, sensitive, or patient data.
• Users retain ownership of any data they upload, generate, or store on the Services.
• Users grant the Service provider a limited, non-exclusive license to access and process data for system management, performance optimization, and troubleshooting purposes.
• The Services may automatically delete data after a specified period or upon completion of a project (as indicated by the specified end date on the request form) unless otherwise agreed.

Users must not:

• Attempt to gain unauthorized access to any part of the infrastructure or other users' data.
• Use the infrastructure to engage in illegal, harmful, or disruptive behavior.
• Violate any institutional policies, including those related to academic integrity and ethical standards.

The Service reserves the right to suspend or terminate accounts of users who violate these terms.

The Service employs security protocols, including encryption and firewalls, to protect user data and infrastructure.

• Users are responsible for securing their own data, including implementing encryption and appropriate access control measures where necessary.
• The Service is not liable for any loss of data, unauthorized access caused by user negligence, or security breaches exploited by malicious activity.

The Service will make reasonable efforts to ensure high availability and performance but does not guarantee continuous access or uptime.

• Users should not rely solely on the Service for critical tasks and are encouraged to maintain their own backups of important data. The Service does not offer backup or archiving solutions.
• Maintenance, updates, or system failures may cause temporary disruptions. Users will be notified in advance of planned maintenance.

Users retain ownership of any intellectual property (IP) generated through their use of the Service, such as research data, code, or publications.

• Users grant the Service provider a limited right to use the IP for support, troubleshooting, and aggregate system improvement purposes.
• The provider is not liable for any IP disputes arising from the use of the Service.

Proper acknowledgment ensures recognition of the facility's contribution and supports its ongoing development and funding.

Users agree to comply with all applicable laws and regulations when using the Service, including but not limited to:

• Data privacy laws.
• Institutional policies regarding research ethics and integrity.
• Compliance with export control laws or research protocols.

This agreement will remain in effect for as long as the user continues to access the Service.

• The provider reserves the right to suspend or terminate access if the user violates these terms or is no longer eligible.
• Users may cancel their accounts at any time by notifying the Service administrator.

The Service provider makes no warranties regarding the availability, performance, or reliability of the infrastructure.

The Service provider may update these terms and conditions from time to time. Users will be notified of any significant changes, and continued use of the Service after the changes are made constitutes acceptance of the revised terms.

Any disputes arising out of or related to these terms will be resolved through arbitration in accordance with the rules of UKE and the laws of Hamburg.
